1. Definitions

In these Terms of Use, the following terms have the meanings set out below:

  1. PinLoopGo: the website, web application, route planner, route generator, map view, Route Instructions, GPX files, Background Information and other services offered by or on behalf of Via Per Via B.V. under the trade name PinLoopGo.
  2. Via Per Via: Via Per Via B.V., provider of PinLoopGo.
  3. User: any natural person or legal entity that visits or uses PinLoopGo, creates an Account, generates a Route, follows a Route or purchases a Paid Service.
  4. Consumer: a User who is not acting for purposes relating to their trade, business, craft or professional activity.
  5. Account: the User’s personal account through which access can be obtained to certain PinLoopGo functions.
  6. Route: a walking, running or recreational route generated or displayed by PinLoopGo, including circular Routes where the start and end point are the same.
  7. Route Instructions: directions, maps, distances, directions of travel, waypoints, GPX files, textual instructions or other information intended to enable a Route to be followed.
  8. Background Information: information about places, buildings, nature, culture, history, points of interest or other subjects shown in or via PinLoopGo.
  9. Paid Service: any paid function, Route, bundle, credit, Subscription or other paid access to PinLoopGo.
  10. Subscription: a periodically paid Paid Service that provides access to certain PinLoopGo functions.
  11. Third-Party Data: data, content, map layers, route data, geocoding data, Background Information, images or other information originating from third parties.
  12. Terms of Use: these terms and conditions.

2. Applicability

  1. These Terms of Use apply to every visit to and every use of PinLoopGo, including generating, viewing, saving, downloading, printing or following Routes.
  2. These Terms of Use also apply to all Paid Services, Accounts, Route Instructions, Background Information and other functions offered via PinLoopGo.
  3. By using PinLoopGo, creating an Account or purchasing a Paid Service, the User accepts these Terms of Use.
  4. Any general terms and conditions of the User do not apply unless Via Per Via has expressly accepted them in writing.
  5. The PinLoopGo privacy statement applies to the processing of personal data. It is available at https://route.pinloopgo.com/privacy.
  6. The PinLoopGo cookie statement applies to the use of cookies and similar technologies.
  7. If PinLoopGo uses services, data, content or software from third parties, the terms, licences, privacy statements or cookie statements of those third parties may also apply.

3. Description of PinLoopGo

  1. PinLoopGo enables Users to have Routes calculated automatically from a chosen starting point, including railway stations, addresses, locations or the User’s current location.
  2. PinLoopGo can, among other things, generate circular Routes where the start and end point are the same.
  3. Depending on the available functions, the User can specify preferences such as distance, direction, orientation, route type, surroundings, accessibility or other parameters.
  4. PinLoopGo can provide Route Instructions in the form of map views, textual directions, GPX files, downloads, links or other navigation aids.
  5. PinLoopGo can enrich Routes with Background Information, including information from public sources such as Wikipedia, Wikimedia, Wikidata, OpenStreetMap or other sources.
  6. Routes and Background Information are compiled automatically or semi-automatically on the basis of available data. This data may be incomplete, incorrect, outdated or temporarily unavailable.
  7. PinLoopGo is intended as an aid for recreational use and not as a professional navigation, traffic, safety, health or emergency service.

4. Account and registration

  1. An Account may be required for certain PinLoopGo functions.
  2. The User must provide correct, current and complete information when registering.
  3. The User is responsible for keeping login details and passwords confidential.
  4. The User must inform Via Per Via immediately if they suspect that an Account, password or payment method is being used without authorisation.
  5. Via Per Via may take reasonable technical and organisational measures to prevent misuse of Accounts.
  6. Via Per Via may temporarily block or terminate an Account in the event of misuse, fraud, unauthorised use, breach of these Terms of Use or a reasonable suspicion thereof.

5. Age and use by minors

  1. PinLoopGo is intended for Users aged 16 and over.
  2. Users under the age of 16 may only use PinLoopGo with the consent of a parent or legal representative.
  3. By using PinLoopGo, the User declares that they are aged 16 or over, or have the consent of a parent or legal representative.
  4. Parents and legal representatives are responsible for the use of PinLoopGo by minors under their supervision.

6. Use of Routes and personal responsibility

  1. Routes, Route Instructions and Background Information are suggestions and aids. They do not guarantee that a route is safe, permitted, accessible, passable, suitable or up to date.
  2. The User always remains responsible for assessing the situation on site.
  3. The User must comply with all applicable laws and regulations, traffic rules, access rules, signs, instructions from authorised persons and local regulations.
  4. The User must not follow a Route if doing so is unsafe, prohibited, physically irresponsible or otherwise unwise.
  5. Routes may include roads, paths, level crossings, bridges, tunnels, nature areas, private land, construction sites, ferries, stairs, unpaved paths or other sections that may be temporarily or permanently unsuitable, closed, prohibited, unsafe, poorly lit, flooded, slippery, busy, inaccessible or impassable.
  6. The User is responsible for, among other things, physical fitness, health, clothing, footwear, visibility, lighting, telephone, battery, internet connection, weather conditions, traffic, time of day, personal safety and any necessary supervision.
  7. The User must stop, turn back or adjust a Route if the situation on site requires this.
  8. PinLoopGo is not an emergency service. In an emergency, the User must contact the local emergency services.

7. Prohibited use

The User may not use PinLoopGo:

  1. in breach of laws or regulations or the rights of third parties;
  2. in a manner that causes damage, nuisance, danger, disturbance or disruption;
  3. for the automated scraping, copying, harvesting, indexing, bulk downloading or republication of Routes, map data, Background Information or other content, unless Via Per Via has expressly granted prior written permission;
  4. for reverse engineering, decompilation, disassembly or analysis of the underlying software, algorithms, APIs or databases, insofar as this may lawfully be prohibited;
  5. to circumvent technical security measures, access restrictions, paywalls, usage limits or licence terms;
  6. to overload, disrupt or damage PinLoopGo, servers, APIs, networks or systems;
  7. to post or distribute incorrect, misleading, fraudulent, discriminatory, hateful, threatening, illegal or otherwise objectionable content;
  8. for commercial exploitation, resale, white-label use or integration into the User’s own products without Via Per Via’s prior written permission.

8. Free functions, credits and Paid Services

  1. Via Per Via may offer PinLoopGo wholly or partly free of charge.
  2. Via Per Via may make certain functions available only as a Paid Service.
  3. Paid Services may include individual Routes, route bundles, credits, Subscriptions, premium functions, downloads, additional Background Information or business access.
  4. Before purchase, Via Per Via states the main characteristics, price, duration, any renewal, payment method and cancellation options of the Paid Service.
  5. Unless otherwise stated, prices for Consumers include VAT.
  6. Via Per Via may change prices, functions and packages. Price changes for ongoing Subscriptions will be announced in advance.
  7. If a price change or functional change is detrimental to the User, the User has the right to cancel the Subscription before the change takes effect, unless the change is minor or required by law.

9. Payment

  1. Payment is made using the payment methods offered by PinLoopGo.
  2. Payments may be processed by external payment service providers.
  3. The User must provide correct and valid payment details.
  4. By purchasing a Paid Service, the User authorises the amount due to be collected or processed using the chosen payment method.
  5. If payment fails, Via Per Via may suspend or terminate access to Paid Services.
  6. Via Per Via does not itself store full payment card details, unless expressly stated otherwise and legally permitted.
  7. For questions about payments, the User can contact info@pinloopgo.com.

10. Subscriptions, automatic renewal and cancellation

  1. A Subscription provides access, for the agreed period, to the functions included in that Subscription.
  2. Unless otherwise stated, Subscriptions are paid in advance.
  3. If a Subscription is renewed automatically, this will be stated clearly before the Subscription is entered into.
  4. A monthly Subscription may be cancelled by the User with effect from the end of the current monthly subscription period, unless a shorter notice period applies.
  5. An annual Subscription may have an initial term of one year. After the initial term, the Subscription may be renewed, but the Consumer may then cancel it subject to a notice period of no more than one month, unless a shorter period applies by law.
  6. Cancellation can be made via the account area or via info@pinloopgo.com.
  7. Cancellation ends access to the Paid Service at the end of the current payment period, unless otherwise stated or required by law.
  8. When a Subscription ends, the Account may continue to exist as a free Account unless the User deletes the Account or requests its deletion.
  9. Via Per Via may terminate or suspend the Subscription if the User breaches these Terms of Use, commits fraud, misuses PinLoopGo or fails to meet payment obligations.

11. Right of withdrawal for Consumers

  1. If the User is a Consumer, an online purchase of a Paid Service may in principle be subject to a statutory 14-day cooling-off period.
  2. The cooling-off period begins when the agreement for the Paid Service is concluded, unless otherwise provided by law.
  3. The right of withdrawal may lapse if the Consumer expressly agrees in advance to immediate delivery or immediate performance of the digital service and acknowledges that this causes the right of withdrawal to be lost, insofar as permitted by law.
  4. This may apply, for example, if immediately after purchase the Consumer gains access to a paid Route, downloads a route file, uses credits, activates a premium function or uses a digital service in whole or in part.
  5. If the right of withdrawal has not lapsed and the Consumer withdraws in time, Via Per Via will refund the payment received in accordance with the applicable statutory rules.
  6. Any exceptions to the right of withdrawal will be stated clearly before purchase.

12. Route credits and individual purchases

  1. Via Per Via may use credits, route bundles or individual purchases.
  2. The validity period, permitted uses and any restrictions of credits or bundles will be stated before purchase.
  3. Credits or bundles are personal and non-transferable unless Via Per Via states otherwise.
  4. Unused credits are not refundable unless required by law or expressly stated otherwise.
  5. Via Per Via may counter misuse of credits, promotions or free Routes, including by applying usage limits or blocking Accounts.

13. Third-Party Data, map data and open sources

  1. PinLoopGo may use Third-Party Data, including map data, route data, geocoding data, elevation data, public transport data, weather data, Background Information, images, texts or other content.
  2. Third-Party Data may originate from sources including OpenStreetMap, Wikipedia, Wikimedia Commons, Wikidata, public authorities, databases, API providers, map suppliers, routing providers or other sources.
  3. Third-Party Data may be subject to its own terms, licences, attribution requirements and usage restrictions.
  4. The User may not remove, conceal or alter source references, copyright notices, licence notices, map attributions or other mandatory notices.
  5. To the extent permitted by law, Via Per Via is not responsible for the accuracy, completeness, currency, availability or lawfulness of Third-Party Data.
  6. If a User believes that content in PinLoopGo is incorrect or infringes the rights of third parties, they can report this via info@pinloopgo.com.

14. Wikipedia, Wikimedia and Background Information

  1. Background Information may originate wholly or partly from public sources such as Wikipedia, Wikimedia Commons, Wikidata or similar sources.
  2. Such content remains the property of the relevant authors, rights holders or licensors.
  3. Content from open sources may be available under Creative Commons licences or other open licences.
  4. Where reasonably possible, PinLoopGo attempts to display or refer to source, author and licence information.
  5. Background Information may be automatically summarised, selected, translated, shortened or combined with other information.
  6. Via Per Via does not guarantee that Background Information is complete, correct, current, neutral or suitable for a specific purpose.

15. Intellectual property

  1. All intellectual property rights in PinLoopGo, including the software, interface, design, name, logo, trademark, database structure, algorithms, texts, images and other proprietary content of Via Per Via, are owned by Via Per Via or its licensors.
  2. The User receives only a limited, personal, non-exclusive, non-transferable and revocable right to use PinLoopGo in accordance with these Terms of Use.
  3. This right of use does not confer ownership or transfer any intellectual property rights.
  4. The User may not copy, modify, sell, rent, sublicense, disclose, republish or commercially exploit PinLoopGo or any part of it without Via Per Via’s prior written permission.
  5. Routes generated by PinLoopGo may be used, saved or followed by the User for personal, recreational use unless otherwise stated.
  6. Business, commercial or large-scale use of Routes, downloads, route files or databases is permitted only with Via Per Via’s prior written permission.

16. User-submitted content

  1. If PinLoopGo offers functions that allow Users to upload, publish or share content, such as reviews, photos, comments, route tips, points of interest or their own Routes, this article applies.
  2. The User remains the owner of their own content, but grants Via Per Via a worldwide, non-exclusive, sublicensable, royalty-free licence to use, display, reproduce, modify, translate, distribute and process that content for the provision, improvement and promotion of PinLoopGo.
  3. The User warrants that they are entitled to post the content and that the content does not infringe the rights of third parties.
  4. The User may not post content that is illegal, misleading, discriminatory, hateful, threatening, pornographic, violent, privacy-infringing, copyright-infringing or otherwise unlawful or objectionable.
  5. Via Per Via may refuse, remove, restrict, moderate or hide content if it breaches these Terms of Use, legislation or reasonable platform rules.
  6. Via Per Via may provide a reporting channel for complaints about illegal or objectionable content via info@pinloopgo.com.
  7. If PinLoopGo does not offer functions that allow Users to publish content, this article applies only once such functions are made available.

17. Privacy, location data and cookies

  1. The use of PinLoopGo may involve the processing of personal data, including account data, contact details, payment data, technical data, location data, route preferences, generated Routes and usage data.
  2. Location data can be sensitive. Via Per Via processes location data only as described in the privacy statement and insofar as there is a valid legal basis for doing so.
  3. The User is responsible for sharing location, Routes and personal information with due care.
  4. Via Per Via may use processors and third parties for, among other things, hosting, analytics, payments, map display, routing, geocoding, email, customer service and security.
  5. More information about the processing of personal data, retention periods, data subject rights and contact options is set out in the PinLoopGo privacy statement.
  6. More information about cookies and similar technologies is set out in the PinLoopGo cookie statement.

18. Availability, maintenance and changes to PinLoopGo

  1. Via Per Via aims to provide a properly functioning and available service, but does not guarantee that PinLoopGo will always operate without interruptions, errors, delays or security issues.
  2. PinLoopGo may depend on an internet connection, GPS, device settings, browser settings, operating system, battery, external APIs, map services, payment services and other third parties.
  3. Via Per Via may temporarily interrupt PinLoopGo for maintenance, security, updates, changes or outages.
  4. Via Per Via may change, add, restrict or remove functions.
  5. Via Per Via may restrict access to PinLoopGo in whole or in part if this is necessary for security, maintenance, legal compliance, fraud prevention, capacity management or protection of the service.
  6. Via Per Via is not required to keep particular functions, Routes, map layers, data sources or integrations permanently available.

19. No warranties

  1. PinLoopGo is provided on the basis of the technology and data available at the time.
  2. Via Per Via does not guarantee that:
  3. Routes are correct, safe, permitted, accessible, passable or up to date;
  4. Route Instructions are error-free or complete;
  5. Background Information is correct, complete, current or neutral;
  6. PinLoopGo is always available or free from disruptions;
  7. PinLoopGo is suitable for a specific purpose of the User;
  8. GPS, map, location or distance data is exact;
  9. a Route meets the User’s personal preferences, fitness, mobility, health or safety expectations.
  10. The User uses PinLoopGo, Routes, Route Instructions and Background Information at their own risk and expense.

20. Liability

  1. To the extent permitted by law, Via Per Via is not liable for damage arising from the use of PinLoopGo, Routes, Route Instructions, Background Information or Third-Party Data.
  2. In particular, Via Per Via is not liable for damage caused by:
  3. incorrect, incomplete or outdated Routes or Route Instructions;
  4. incorrect, incomplete or outdated Third-Party Data;
  5. closed, prohibited, dangerous, impassable or unsuitable roads, paths or areas;
  6. traffic conditions, weather conditions, darkness, slipperiness, flooding, crowds, roadworks or events;
  7. loss of GPS signal, poor internet connection, an empty battery or device problems;
  8. physical injury, health complaints, fatigue, getting lost or unsafe choices by the User;
  9. acts or omissions of third parties;
  10. temporary or permanent unavailability of PinLoopGo.
  11. Nothing in these Terms of Use excludes liability to the extent that such exclusion is not permitted by law, including liability for intent or deliberate recklessness on the part of Via Per Via.
  12. If Via Per Via is nevertheless liable, its liability is limited to the amount paid by the User to Via Per Via for the relevant service in the twelve months preceding the event causing the damage, unless the law requires a different limitation.
  13. For Consumers, the limitation of liability applies only to the extent permitted by law.
  14. The User must report damage to Via Per Via as soon as possible and no later than 14 days after discovery.

21. Indemnity

  1. The User indemnifies Via Per Via against claims by third parties arising from or relating to:
  2. the User’s use of PinLoopGo;
  3. breach of these Terms of Use;
  4. unlawful use of Routes, Route Instructions, content or Third-Party Data;
  5. content posted or shared by the User;
  6. infringement of the rights of third parties.
  7. This indemnity does not apply to the extent that the claim results from intent or deliberate recklessness on the part of Via Per Via or to the extent that the law does not permit the indemnity.

22. Termination

  1. The User may stop using PinLoopGo at any time.
  2. The User may delete the Account or request deletion via info@pinloopgo.com.
  3. Via Per Via may suspend or terminate access to PinLoopGo or the Account if the User:
  4. breaches these Terms of Use;
  5. fails to meet payment obligations;
  6. commits or attempts to commit fraud;
  7. misuses PinLoopGo or disrupts its operation;
  8. infringes the rights of Via Per Via or third parties;
  9. acts in breach of laws or regulations.
  10. After termination, the User’s rights of use end unless these Terms of Use or the law provide otherwise.
  11. Provisions which by their nature are intended to remain in force after termination will continue to apply. This includes provisions on intellectual property, liability, indemnity, applicable law and disputes.

23. Complaints and contact

  1. Questions, complaints or reports concerning PinLoopGo can be sent to info@pinloopgo.com.
  2. Via Per Via aims to respond to complaints within a reasonable period.
  3. A complaint should be described as fully as possible so that Via Per Via can handle it properly.
  4. For privacy requests, the User can contact info@pinloopgo.com.
  5. Reports concerning incorrect Routes, dangerous situations, incorrect information or possible infringement of rights can be sent to info@pinloopgo.com.

24. Changes to these Terms of Use

  1. Via Per Via may amend these Terms of Use.
  2. The most recent version is available via the PinLoopGo website or web application.
  3. In the event of material changes, Via Per Via will inform Users in an appropriate manner, for example via the website, web application, account area or email.
  4. Changes take effect at the time stated in the announcement.
  5. If a change is materially detrimental to a User with an ongoing Subscription, the User may terminate the Subscription before the change takes effect, unless the change is required by law or is of minor significance.
  6. By continuing to use PinLoopGo after the amended Terms of Use take effect, the User accepts the amended Terms of Use.

25. Transfer

  1. Via Per Via may transfer rights and obligations under the agreement with the User to a third party in connection with a merger, acquisition, restructuring, transfer of business or transfer of PinLoopGo.
  2. The User may not transfer rights and obligations under the agreement with Via Per Via without Via Per Via’s prior written permission.

26. Invalidity or voidability

  1. If a provision of these Terms of Use proves to be invalid, void or voidable, the remaining provisions will remain fully in force.
  2. Via Per Via and the User will replace the invalid provision with a valid provision that reflects the purpose and intent of the original provision as closely as possible.

27. Applicable law and disputes

  1. These Terms of Use and the use of PinLoopGo are governed by Dutch law.
  2. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law designates another court.
  3. Consumers may also bring proceedings before the court that has jurisdiction under mandatory consumer law.

28. Business users

  1. If the User uses PinLoopGo on behalf of an organisation, company, foundation, association, public authority or other legal entity, the User declares that they are authorised to represent that party.
  2. Additional or different arrangements may apply to business users, for example regarding API use, bulk use, white-label applications, station routes, tourism applications, licences, SLAs, invoicing, support or commercial exploitation.
  3. If there is a conflict between these Terms of Use and a written agreement between Via Per Via and a business customer, the written agreement prevails.

29. Specific provisions for station Routes

  1. PinLoopGo may offer or generate Routes from or around railway stations, stops or other public transport locations.
  2. The availability of a Route from a station does not mean that the Route has been approved, checked or recommended by a railway company, transport operator, station manager, municipality, province, land manager or other third party.
  3. The User is responsible for complying with rules at stations, platforms, level crossings, station areas and public transport locations.
  4. The User may not enter railway tracks, operational areas, prohibited areas or other non-public sections.
  5. Timetables, works, accessibility and station facilities may change. PinLoopGo does not guarantee that information about them is complete or current.

30. Summary for Users

This summary is intended to explain the main points in an understandable way. If there is any difference between this summary and the full Terms of Use, the full Terms of Use prevail.

  1. PinLoopGo helps you find and follow routes, often with the same start and end point.
  2. Routes are suggestions. Always check for yourself whether a route is safe, permitted and passable.
  3. Follow traffic rules, signs and local instructions.
  4. Stop or change your route if the situation is unsafe or prohibited.
  5. Maps, route data and Background Information may contain errors or be outdated.
  6. Do not use PinLoopGo for scraping, misuse, overloading or commercial republication without permission.
  7. Paid Services are subject to the prices, durations and cancellation rules shown at the time of purchase.
  8. The PinLoopGo privacy statement and cookie statement apply to personal data, location data and cookies.
